Drivers License Revocation

There is a body of law that is separate from the drunk driving statute, called the implied consent statute that allows for immediate revocation of a driver's license upon failing a breath, blood or urine test. This revocation does not hinge on whether or not the DWI/DUI charge actually results in a conviction. Even if you are not convicted, it is possible to still face license revocation, because this is a separate process.

This process was created by the Minnesota Legislature with the goal of taking peoples' licenses away 100 percent of the time after a DWI/DUI arrest. The Legislature wants a 100 percent success rate, but we refuse to let that happen. We have the ability to challenge license revocation in court. This process is called the judicial review of the license revocation. We know how to make these challenges successful.

Vehicle Forfeiture

Under certain circumstances, the law permits the prosecution to seize and keep a vehicle used in the commission of a crime. More often than not, these situations involve multiple DWI/DUI offenses, although certain drug charges can result in forfeiture, as can fleeing a peace officer in a motor vehicle.

If you have had your vehicle taken away, it is important that you act quickly. If the paperwork to challenge the forfeiture is not filed within a very short deadline (20, 30 or 60 days, depending on the case), the prosecutors get to keep your vehicle, whether they were right or wrong in taking it.
